Upon submission of your online information and a copy of your judgment, payment of the appropriate up front fees and costs, if applicable, and our acceptance of your request for services, Joseph & Marees, P.A. will provide judgment collection assistance and/or representation on the following terms and conditions, depending upon the level of services requested:
If this option is chosen, Joseph & Marees, P.A. will conduct an extensive online asset investigation, review and analyze your Florida Judgment to confirm that it contains the language and information required by the Florida Statutes to be fully enforceable, determine whether or not your judgment has been properly recorded and filed with the appropriate government agencies in order to create liens or establish priority on any real or personal property owned by the judgment debtor(s), and determine the deadlines and Statutes of Limitation applicable to the viability and enforceability of your Final Judgment. We will also attempt to verify all other judgments, liens or encumbrances filed against the debtor(s). A detailed report will be prepared and provided to you summarizing our findings, including the existence of any assets which might be available to partially or fully satisfy your judgment, as well as any action that may need to be taken to correct any deficiencies discovered as a result of our review and analysis. Additionally, we will be available for a telephone consultation to discuss the results of our investigation, review and analysis, and recommendations. It is expressly understood and agreed that Joseph & Marees, P.A. will not be filing an appearance in the underlying action or otherwise undertaking representation on your behalf. Our scope of work is expressly limited to the tasks specified in this package as described on our website.

Additionally, we will be available for a telephone consultation to discuss the results of our investigation, review and analysis, contact with the debtor(s), and recommendations. It is understood and agreed that Joseph & Marees, P.A. will be entitled to a fee of thirty-five percent (35%) of all sums recovered after submission of your request for our services, whether the payment is made to our offices or directly to you. It is expressly understood and agreed that Joseph & Marees, P.A. will not be filing an appearance in the underlying action or otherwise undertaking representation in the underlying action on your behalf. Our scope of work is expressly limited to the tasks specified in this package as described on our website. By submission of your online request for these services, you hereby appoint Joseph & Marees, P.A., as your attorney in fact to accept payments from the debtor(s) on your behalf and to deduct its fees from said payments prior to remittance to you. Remittances will generally be sent to you within 21 days of receipt. In the event that the debtor makes a direct payment to the you, you agree to forward the payment to Joseph & Marees, P.A. for processing as provided herein, or alternatively, you will promptly pay Joseph & Marees, P.A. the fees due on such payment.

Our services will include filing a Notice of Appearance as your attorneys for post-judgment collection action, preparing and filing any additional documents needed to correct any deficiencies discovered in your judgment, recording your Final Judgment in the official records of the county or counties where we have reason to believe that the debtor(s) reside or own real property, and filing a Judgment Lien Certificate with the Florida Department of State so as to create a lien on the real and personal property of the debtor (if these steps have not already been performed). Further, formal written demand will be made upon the debtors and we will follow up with telephone contact in an attempt to make amicable arrangements for resolution of this matter. It is understood and agreed that, in addition to the upfront fees and costs paid upon submission of your request for services, Joseph & Marees, P.A. will be entitled to a fee of thirty-five percent (35%) of all sums recovered after submission of your request for our services, whether the payment is made to our offices or directly to you. In addition to the attorney's fees which you agree to pay, you agree to pay all costs incurred such as filing fees, service of process fees, court reporter fees, long distance telephone calls, overnight delivery charges, etc., once your initial cost advancement has been expended. Additionally, we will order a bank account locate for bank accounts belonging to the judgment debtor(s). These will be provided at the cost incurred by the firm to conduct said searches. Typically, the search cost per debtor is $195.00. In the event bank accounts are located and a writ of garnishment is recommended, we will advise you of any additional costs which may be required to obtain the writ from the court and have the same served upon the debtor's bank account. Post-judgment enforcement efforts including a deposition in aid of execution or a levy on real estate or personal property may require additional fees or an additional advancement of costs, if the initial advancement for costs has been depleted. Should Proceedings Supplementary be required, should any litigation arise out of our post-judgment collection efforts (ie. disputed matters requiring legal research, legal argument or evidentiary hearings) or should travel be required, we reserve the right to charge for our services at our normal hourly rate then in effect upon said occurrence or, alternatively, request an additional non-contingent fee to be applied against the contingency fee set forth above. Any additional fees and costs will be submitted to you for approval before any such expense is incurred. Additionally, we will be available for telephone consultation to discuss all aspects of the results of our investigation, review and analysis, contact with the debtor(s), and recommendations. Public Records and commercially available data sources used on our reports do contain errors. Data is sometimes entered poorly or processed incorrectly and Joseph & Marees, P.A. has no control over the input, maintenance or update of existing data. Before taking any further action or otherwise relying on data obtained from online databases, the data should be independently verified. If you or your attorneys misrepresent or fail to disclose material facts to us, or fail to cooperate with us, or if you fail to pay our statements for legal services or costs, if applicable, you understand and agree that we have the right to withdraw from further representation and to apply any retainer, if applicable, toward any unpaid bills. This law firm will diligently perform the requested services and provide recommendations regarding the steps we believe are necessary to protect your interests. You authorize us to divulge any information we feel necessary about your case in order to achieve the most satisfactory result. Unless further arrangements are made, our representation is limited to performance of the tasks delineated in the Report, Action and Enforcer options described on our website and does not include taking any steps to extend any judgment liens beyond their original life as to either real or personal property, re-recording certified copies of final judgments, renewing judgment lien certificates or furnishing you with any notices or reminders as to those occurrences, unless agreed upon in a separate writing signed by you and Joseph & Marees, P.A.
